Legal and Ethical Issues

Environmental compliance is a thing that plays a positive role for further successful business development. According to the latest news, the main focus of the business should be avoiding environmental liabilities. The main objective of this paper is to prove that complying with environmental regulations is good for business and can keeps CEOs out of jail. In addition, a whole thing saves the companies from paying fines. Now in many companies there is a tendency to reward companies that engage in environmental compliance.

Joan, the main actor described in the study was currently faced with the decision whether or not to spend money on new and very expensive technology that will completely eliminate the level of a particular toxin. In the case with Joan the toxin is dimethylhydroxytolamine or DHT. The toxin flows out the back of the factory and into the river and may have a dangerous effect on the environment.

Joan tests all the plant’s emissions into the air and the river for all chemical pollutants on a regular basis. The KIMCO factory's emission levels for all pollutants, including DHT can be evaluated as the ones that state within Federal and state legal limits. However, Joan believes that environmental regulations for the DHT toxin are lagging behind the latest scientific evidence.  The situation is hampered by recession that actually reduced the production of the plant. Introduction of the new extensive environmental systems means damaging the profitability of the plant, thus the removal of its purification systems.

 Environmental states

The evolution of environmental statutes resulted in a big changes in the whole issue. The environmental statutes can be divided into three main categories:  preservation statutes, regulation and control over the sale of chemicals, and command and control regulations aimed at reducing pollution. The understanding of the whole issue can be achieved only through a careful analysis of the whole case.

  Environmental crimes

Environmental crimes often serve to be a reason of debates. Many prosecutors have targeted manufacturers for systemic dumping of toxic waste.  In fact, environmental crime is such a serious issue that it often crosses international borders. The criminal sanctions that are taking against particular business are supposed to enforce environmental laws leading to the assessments of the key legal and ethical issues that arise as a result of these prosecutions.

The discussion includes the analysis of compliance strategies for businesses. These have the potential to redress environmental harm through international criminal sanctions.
